Clear Lake man files lawsuit against City Administrator

    A Clear Lake man is requesting a jury trial to hear his claim against Clear Lake City Administrator Scott Flory.
    Wayne Anderson, who operates an independent lawn care business, has filed a four-count lawsuit against Flory, alleging he was singled out to pay a disposal fee for lawn clippings taken to the city’s Yard Waste Disposal Site in 2007.
    Anderson states in the suit that he chose to “exercise his First Amendment rights to protest” by placing a “No to Scott Flory” sign on his pickup truck.
    Anderson alleges Flory ordered the Clear Lake Police Department to charge him with harassment for placing the sign on the truck.  That charge was dismissed.
    In the weeks to follow, Anderson was charged two more times.  Each time, the charge was dismissed.
    Anderson claims to have suffered damages in the form of “public ridicule by the charges filed against him.”  He also alleges Flory used the criminal process wrongly in an effort to stop his lawful actions.
    Anderson, who is represented by Mason City attorney Rolf Aronsen, is seeking actual and punitive damages, court costs, attorney fees and additional monetary settlement.
    Flory is represented by Clear Lake attorney James Stanton.
